What is legally gifting under MRTA
The MRTA permits adults 21+ to gift cannabis to other adults 21+ under these specific conditions:
- The gift is up to 3 ounces of flower OR 24 grams of concentrate
- Both parties are 21 or older
- No money is exchanged
- The gift is not tied to any other purchase
- The gift is not advertised for sale
A simple legitimate example: an adult 21+ gives a friend (also 21+) a 1g vape from their personal supply, no payment expected, no other transaction tied to the gift.
This is legal under MRTA.
What is NOT legal: "donation" or "sticker purchase" workarounds
A pattern emerged in 2022-2023: pop-up shops or events where customers paid for a "sticker" or "T-shirt" or "donation" and "received cannabis as a gift."
This is illegal sales without a license. The legal name is the "gifting loophole" theory, and NY courts and OCM have been clear: ANY money or value exchange tied to cannabis gifting is a sale, not a gift, regardless of how the transaction is labeled.
The penalty for selling cannabis without a license is significant (felony charges).
What is NOT legal: gift "for advertising purposes"
A business cannot:
- Advertise "free cannabis with purchase"
- Bundle cannabis with another product or service for promotional reasons
- Use cannabis as a giveaway or promotional incentive
These are all considered sales by the OCM.
What is NOT legal: gifting between minors or to minors
- An adult 21+ may NOT gift cannabis to anyone under 21
- Two adults under 21 may NOT exchange cannabis even non-commercially
- Possession by anyone under 21 is a civil violation
What is NOT legal: gifting across state lines
Cannabis remains illegal under federal law. Transporting cannabis across state lines is a federal offense, regardless of state legalization status. This includes:
- Gifting to a friend in NJ, CT, MA, etc., even though those states are also legal
- Mailing cannabis (which is also a federal mail-fraud offense)
- Carrying cannabis through an airport (TSA falls under federal jurisdiction)
If your friend in NJ wants legal cannabis, they should buy from a NJ dispensary.
What is NOT legal: gifting in workplace or school settings
- No cannabis transfer at workplaces (many employers prohibit, NY law does not protect)
- No cannabis transfer in schools or on school grounds
- No cannabis transfer in federal buildings
How OCM enforcement works
NY Office of Cannabis Management has been active in 2024-2025 enforcement against:
- Unlicensed shops claiming "gifting" structures
- Pop-up cannabis events with disguised sales
- Online "donation for cannabis" platforms
- Storefronts using sticker, art, or merchandise pricing tied to cannabis gifts
If you suspect an operation is running a fake-gifting structure, the OCM has a public reporting channel.

Yes, if mom is 21+, you can give her up to 3 oz of flower or 24 g of concentrate as a no-strings gift after you legally purchase from us.
What you cannot do: tell mom to "Venmo you back" for the cost. That converts the gift into a sale, and you would need a NY OCM license to legally sell.
What is changing
The OCM has been signaling that the gifting framework may eventually be tightened or refined. The current pattern is rough enforcement against the most flagrant fake-gifting operations, with relative tolerance of legitimate adult-to-adult personal gifting.
