New York Cannabis Laws: A Plain-Language Guide for Queens and Long Island Adults

New York legalized adult-use cannabis in 2021 under the Marijuana Regulation and Taxation Act (MRTA). The state Office of Cannabis Management (OCM) writes the rules, issues the licenses, and runs the enforcement system that separates legal dispensaries like Sage Seeds (license **OCM-RETL-24-000004**) from the unlicensed shops that still operate in some neighborhoods. This hub explains what New York adults can legally do with cannabis, where they can do it, and how to tell whether the store they are walking into is real or not. The information here is current as of 2026 and is reviewed against OCM publications and the New York State Senate's MRTA text. It is general information, not legal advice. For an official answer to a specific situation, consult an attorney.

The four most-asked questions, in summary

How much cannabis can a New York adult legally possess? Up to 3 ounces of flower or 24 grams of concentrate on your person at one time. At home, the limits are higher. The full breakdown is on the possession limits page.

Where can I smoke it in public? Generally, anywhere tobacco smoking is permitted, with major exceptions: not within 100 feet of a school, not in state parks, not in cars whether parked or moving, not in most hotels, and not in places of employment that maintain smoke-free workplace policies. Full breakdown at where you can smoke.

How do I know a dispensary is legal? Two checks. First, ask for the OCM-RETL license number and a NY State Cannabis Conditional Adult-Use Retail Dispensary placard (or, for newer permits, the standard adult-use retail license). Second, look up the address at the official OCM dispensary verification tool. If a store cannot show you a license number on the wall and does not appear in the OCM tool, it is unlicensed and the products are not lab-tested. Sage Seeds is licensed under OCM-RETL-24-000004.

Why is there no dispensary in Nassau County? Nassau County opted out of allowing adult-use retail dispensaries under MRTA's local-opt-out provision. That decision is why the closest legal dispensary for residents of Floral Park, Garden City, Hempstead, Mineola, New Hyde Park, and the rest of western Nassau is Sage Seeds, located one block over the Queens line at 248-15 Union Turnpike, Bellerose. Full background on the Nassau opt-out page.

Why this hub exists

Most New York cannabis customers do not have time to read a 100-page state regulation. They want a clear answer to a specific question, written by people who actually have to follow the rules every day. The Sage Seeds team builds and maintains this library because correctly informed customers make better choices, ask better questions at the counter, and avoid the legal risk that comes from buying or carrying cannabis incorrectly. We update the pages when OCM issues new guidance, and we date-stamp each guide so you know when it was last reviewed.
