What the opt-out actually did
The MRTA created two licensed retail categories: adult-use cannabis dispensaries and on-site consumption lounges. Each NY town/city/village had until December 31, 2021 to vote to opt out of either or both. Once a municipality opted out, no licensed retail or consumption could operate within its borders unless the government later voted to opt back in.
Nassau County itself does not directly control retail policy at this level. The decision was made by individual town and village governments. By the December 2021 deadline:
- Town of Hempstead opted out
- Town of North Hempstead opted out
- Town of Oyster Bay opted out
- City of Long Beach opted out
- City of Glen Cove opted out
- Most Nassau villages opted out
The result: legal adult-use dispensaries cannot operate anywhere in Nassau County as of [VERIFY date].
Why municipalities opted out
The reasons varied by jurisdiction, but the common arguments included:
- Concerns about youth access despite 21+ laws
- Pressure from school districts and parent associations
- Uncertainty about zoning and traffic impact
- Wait-and-see approach to observe NYC's experience first
- Tax revenue arguments versus public-safety concerns
Several Nassau municipalities have held subsequent local conversations about opting back in, but as of [VERIFY date] no Nassau town has reversed its 2021 opt-out.
What this means for Nassau residents
If you are a Nassau adult who wants to legally purchase cannabis:
- You cannot buy from a Nassau dispensary because none exist legally
- You can drive to NYC dispensaries (Queens dispensaries like Sage Seeds in Bellerose are the closest for most western Nassau residents)

Could Nassau opt back in?
The opt-out is not permanent. NY law allows a municipality to vote to opt back in at any time. Some Nassau elected officials have publicly discussed revisiting the question, citing tax revenue and the proliferation of unlicensed shops in NYC bordering Nassau.
