New York Cannabis Purchase Limits at Licensed Dispensaries: 2026 Rules

The Sage Seeds team gets the same purchase-limit question multiple times daily. The short answer: 3 ounces of flower or 24 grams of concentrate per transaction. The longer answer involves how multi-product purchases convert, how the 30-day medical limit works, what changes apply to delivery, and how this all syncs with the carry limit. Here is the full working version. This is plain-language summary, not legal advice.

Adult-use purchase limits per transaction

A NY licensed dispensary like Sage Seeds may sell to an adult 21+ in a single transaction:

  • Up to 3 ounces of cannabis flower (84 grams)
  • Up to 24 grams of concentrated cannabis (anything processed beyond raw flower)
  • Or a combination that does not exceed either cap

Most NY shoppers stay well below these limits in a single purchase. A typical Sage Seeds basket is 1 to 2 eighths of flower (3.5 to 7 grams) plus an edible or vape, totaling well under both caps.

How concentrate weight is calculated

The 24-gram concentrate cap is measured by the actual cannabis-derived oil/extract weight, not the total package weight. So:

  • A 1-gram disposable vape counts as 1 gram against the cap (the oil itself)
  • A pack of 100 mg gummies counts as the cannabis content within (a fraction of a gram), not the total candy weight
  • A live resin jar labeled 1 g counts as 1 gram
  • A 1-mL tincture at 30 mg/mL THC counts as the THC content (much less than 1 g)

In practice, an adult shopper would have to be buying a significant quantity of vape carts or concentrates to approach the 24-gram cap. Edibles and tinctures rarely come close.

Combined cap math

A combined transaction has both flower and concentrate caps applied:

  • Buying 2 oz of flower + 12 g of concentrate is allowed (under both caps)
  • Buying 3 oz of flower + any concentrate would only be allowed if the concentrate was zero (you are at the flower cap)
  • Buying 24 g of concentrate + any flower would only be allowed if the flower was zero (you are at the concentrate cap)

This rarely affects normal shoppers but matters for hosts and gift-givers buying for an event.

Same-day multiple visits and online orders

NY does not currently impose a daily purchase cap across multiple transactions. You could in principle buy at the cap, leave, return later, and buy again. However:

  • The carry limit (3 oz / 24 g) applies to your possession in public. Buying twice the cap in a day means you cannot legally carry it all home in one trip.
  • Splitting orders to avoid possession limits is not a workaround. Police and OCM apply possession limits to what you actually have on you.
  • Most adults do not need to buy at the cap. A single purchase covers most adult shoppers for weeks.

For online orders (pickup or delivery from Sage Seeds), each order is limited to one transaction at the legal cap. You can place additional orders, but each must be a separate transaction.

How delivery affects purchase limits

Delivery follows the same per-transaction caps. Sage Seeds delivery to Queens, Nassau, and Suffolk:

  • Queens minimum order: $50
  • Nassau and Suffolk minimum order: $100

Medical cannabis purchase limits

If you are a registered NY medical patient (separate program from adult-use), you are entitled to a 60-day supply as recommended by your certifying provider. This is calculated based on your specific certification, not the adult-use cap. Most medical patients can purchase higher quantities per transaction than adult-use shoppers, with quantities specific to their treatment plan.

Are there age-specific or other purchase restrictions?

  • Must be 21 or older with valid government-issued ID
  • No purchase if visibly impaired by alcohol or other substances
  • No purchase if attempting to buy for a minor (this is a felony)
  • No purchase across state lines (federal jurisdiction; do not bring NY cannabis across state borders)
  • Out-of-state IDs accepted if the buyer is 21+ (NY does not require state residency for adult-use)

How payment works at NY dispensaries

NY licensed dispensaries cannot accept standard credit cards due to federal banking restrictions. Sage Seeds accepts:

  • Aeropay (mobile bank-link payment)
  • ACH transfer (direct from your bank)
  • Cash (exact preferred; on-site ATM available [VERIFY])
  • Debit cards through Aeropay or compliant processors

This payment-rail limitation is the same at every NY licensed dispensary. The cash-and-Aeropay reality is a federal-banking issue that affects all licensed cannabis retail in the US.
