New York Cannabis Possession Limits: What Adults 21 and Older Can Legally Carry in 2026

The Marijuana Regulation and Taxation Act (MRTA) became law in New York in 2021 and remains the framework for adult cannabis possession in the state. The Sage Seeds team gets asked about possession limits more than any other legal question at the Bellerose counter. Here is the working version. This page is a plain-language summary, not legal advice.

The hard numbers (MRTA, NYS Cannabis Law § 222)

Adults 21 and older in New York may legally possess:

  • Up to 3 ounces of cannabis flower
  • Up to 24 grams of concentrated cannabis (vape oil, live resin, edibles measured by THC, etc.)
  • Either or both, simultaneously, up to those caps

These are the carry limits in public. They apply to your person, your bag, and the cannabis you transport from a licensed dispensary like Sage Seeds back to wherever you are going.

Home storage limits

Inside your private residence, MRTA allows:

  • Up to 5 pounds of cannabis flower for personal use, properly stored
  • "Properly stored" means in a closed container, out of reach of minors, and not visible from outside the home

Note the gap: 3 ounces in public, 5 pounds at home. The state recognized that keeping people from buying and storing more than they can use in a single trip would not work, while still limiting public carry to a sensible amount.

What "concentrated cannabis" means for the cap

Concentrated cannabis is anything that has been processed beyond raw flower. The 24-gram concentrate cap covers:

  • Vape cart and disposable oil (the actual oil weight, typically printed on packaging)
  • Live resin, live rosin, distillate, hash, kief, dabs
  • Edibles (measured by total cannabinoid content; most NY edibles list net weight and total THC)
  • Tinctures (the cannabinoid content within the bottle)

A typical 1-gram disposable contributes 1 gram to the 24-gram cap. A 100 mg edible package contributes a fraction of a gram (the actual THC is the unit). Most adult shoppers do not approach the 24-gram limit in a single purchase.

Purchase limits per transaction at NY dispensaries

NY licensed dispensaries enforce the same caps at the register:

  • Maximum 3 ounces of flower per single transaction
  • Maximum 24 grams of concentrate per single transaction
  • Combined within those caps

Sage Seeds and every other licensed NY dispensary will not exceed these limits per visit. Multiple visits in the same day are not capped at the state level, but combining purchases above the carry limit creates legal risk on the way home.

What is NOT covered by these limits

  • Plants: Adult home cultivation of cannabis is permitted in NY (3 mature, 3 immature per adult, 6 mature and 6 immature per household max), separate from possession limits. Cultivation rules became fully active in 2024.
  • Medical patients: Registered medical cannabis patients may possess a 60-day supply as recommended by their certifying provider. This is a separate framework. See medical vs adult-use cannabis in NY.

Where you can carry cannabis

You may carry cannabis up to the legal limits anywhere you can carry tobacco in NY, with several important exceptions. You may NOT carry cannabis:

  • Across state lines (federal law still classifies cannabis as Schedule I; interstate transport is a federal crime regardless of state laws)
  • Onto federal property (post offices, federal buildings, national parks)
  • Through TSA checkpoints (federal jurisdiction)
  • Onto airline flights, even from one legal state to another
  • Into venues that prohibit it via posted signage
  • Into your workplace if your employer prohibits it (employers retain the right to set workplace cannabis policies)

Vehicle carry rules

When transporting cannabis in a vehicle:

  • Cannabis must be in a sealed, original packaged container (the resealable bag from Sage Seeds qualifies)
  • Open containers in the passenger compartment are not allowed, similar to alcohol open-container rules
  • Best practice: trunk or out-of-reach storage for the duration of transport

What happens if you go over the limit

Possession over the legal carry cap (3 oz flower / 24 g concentrate) is a violation that can escalate to a misdemeanor or felony depending on quantity. The state has decriminalized minor amounts but enforcement still applies above the caps. The simplest rule: do not buy more in a single trip than the cap allows.
