The hard rule: NY VTL § 1192(4) and § 1192(4-a)
New York Vehicle and Traffic Law § 1192(4) prohibits driving while impaired by drugs (DWAI-Drugs). § 1192(4-a) prohibits driving while impaired by the combined influence of drugs and alcohol. Cannabis falls under both. There is no per-se THC blood limit in NY (unlike alcohol's 0.08 BAC). Instead, NY uses observed impairment: officers evaluate driving behavior, field sobriety tests, eye movement, and statements.
A first-offense DWAI-Drugs conviction can include:
- License suspension of at least 6 months
- Fine of $500 to $1,000
- Up to 1 year jail
- Mandatory drug-and-alcohol education program
- Increased insurance rates for years afterward
- Permanent record that affects employment, housing, and credit
Repeat offenses escalate quickly. A second DWAI-Drugs within 10 years is a felony.
How long should you wait to drive after using cannabis?
The honest answer the Sage Seeds team gives shoppers depends on the format and dose. These are conservative ranges; individual factors vary:

These wait times assume you do not feel any subjective impairment. If you still feel any cannabis effect, you are too impaired to drive regardless of the clock.
Why cannabis impairment is different from alcohol impairment
A few honest things adults should know:
- THC stays in your blood and tissue much longer than alcohol. A user who consumed cannabis 24 hours ago could still test positive for THC metabolites, but they may no longer be impaired. NY law requires actual impairment, but enforcement and detection are imperfect.
- Heavy chronic users metabolize differently. A daily user may have detectable THC in blood weeks after stopping. They are not impaired weeks later, but they are detectable.
- There is no roadside breathalyzer for cannabis. Detection relies on observed behavior and field tests.
- Cannabis impairment is real even when subtle. Studies show measurable impacts on reaction time, lane control, and decision-making at doses many users do not perceive as "high."
What a roadside cannabis stop looks like in NY
If pulled over and an officer suspects cannabis impairment:
- You will be asked questions about recent use. Anything you say can be used. You are not required to answer.
- You may be asked to perform field sobriety tests. These are voluntary in NY but refusing them does not prevent arrest.
- An officer trained as a Drug Recognition Expert (DRE) may be called. The DRE evaluation is the primary impairment assessment for cannabis stops.
- A blood test may be requested. Implied consent law applies: refusal results in automatic license suspension.
The single best thing you can do is to not drive within the wait windows above. The second best thing is to know your rights but understand that refusing tests has its own consequences.
Passengers and cannabis in vehicles
It is illegal to consume cannabis (smoke, vape, eat, or drink) in a vehicle in NY, whether driving or as a passenger. Open containers of cannabis in the passenger compartment are also prohibited, similar to open-alcohol container rules. Cannabis must be in a sealed container, ideally in the trunk or out-of-reach.
Rideshare and other safer options
If you are using cannabis socially and need to get somewhere:
- Uber, Lyft, traditional taxi: All work fine. Cannabis on your person is legal up to NY caps. Do not consume in the vehicle.
- Public transit: Same rule. You can carry, you cannot consume.
- Designated driver friend: Standard practice.
- Walk: Legal, but be aware of your surroundings.
