How to know a NY dispensary is legal
A licensed NY adult-use cannabis dispensary will have:
- A visible OCM license posted in the store, with the format OCM-RETL-XX-XXXXXXX. Sage Seeds is OCM-RETL-24-000004.
- A New York State Office of Cannabis Management (OCM) seal at the entrance.
- A NYS Universal Symbol on every product (the white triangle with a black T inside).
- Lab-tested products with COAs (Certificates of Analysis) available on request. See COA explained.
- Proper packaging with batch numbers, lab test dates, and brand registration.
- An ID check at the door, not just at the counter.
- The dispensary appears in the official NY OCM dispensary locator.
If a shop fails any of these, it is operating illegally regardless of how nice the storefront looks.
What unlicensed shops look like
Unlicensed shops have proliferated since 2021. They often:
- Have generic names ("Smoke Shop," "Wellness Center," "CBD World")
- Display cannabis openly without proper packaging or testing
- Sell to anyone, including underage customers
- Display products that look professional but lack the NYS Universal Symbol
- Display brand names you have never heard of, often imitating real brands
- Take cash only and operate without payment processors
- Are cited in news stories as targets of OCM and NYC enforcement actions
The 2024 NY enforcement push has closed thousands of unlicensed shops, but new ones still appear. If a shop is not on the official OCM locator, it is unlicensed.
The actual safety risks of unlicensed cannabis
This is not a theoretical concern. Untested cannabis products in NY have been documented to contain:
- Heavy metals (lead, cadmium, arsenic) at levels well above FDA limits
- Pesticides banned for use on cannabis in NY at toxic concentrations
- Mold and bacterial contamination at levels that produce respiratory issues
- Vape carts cut with vitamin E acetate (the additive linked to EVALI lung injuries in 2019-2020)
- Mislabeled THC content (often dramatically lower or higher than the package claims)
- Counterfeit packaging mimicking real licensed brands
Licensed NY product is tested for all of the above before it reaches a Sage Seeds shelf. Unlicensed product is tested for none of it.
The price gap is small (and getting smaller)
A common shopper assumption: licensed cannabis is much more expensive than gray-market cannabis. As of [VERIFY date], this is mostly false. Licensed NY flower and edibles are within 10 to 30% of unlicensed pricing for comparable products, and the price gap continues to narrow as licensed retail expands. Many licensed dispensaries (Sage Seeds included) regularly run promotions, loyalty programs, and bundle pricing that bring the effective price equal to or below unlicensed shops.
When you factor in product safety, accurate dosing, and supporting NY tax revenue and the state's social equity licensees, the value calculation is no longer close.
What NY taxes you pay at a licensed dispensary
Cannabis purchases at licensed NY dispensaries include:
- 9% NY State Cannabis Excise Tax (replaced the THC-potency-tax in 2025)
- 4% Local Excise Tax (county/municipal)
- Standard NY State and local sales tax does not apply to cannabis (cannabis tax replaces it)
Total tax is typically 13% on top of pre-tax product price. Licensed dispensaries display total at the register. Gray-market shops collect no tax (which is part of why they sometimes appear cheaper, and one of the reasons enforcement targets them).
What to do if you suspect a shop is illegal
NY OCM accepts reports of unlicensed cannabis sales. The reporting form is at the OCM website. Unlicensed shop reports help direct enforcement resources. You can verify any NY cannabis retailer through the OCM dispensary locator before you walk in.

If you are buying cannabis in New York, the only path that gives you tested product, accurate labels, and legal protection is a licensed dispensary.
